1. Acceptance of Terms
By accessing or using the CERTAFI platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all users, including builders, company owners, team members, customers, and visitors.
We reserve the right to update these Terms at any time. We will notify registered users of material changes by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
2. Description of Service
CERTAFI is a certification evidence and release record system for tiny home builders and the certification bodies that review them. The Service stores builder-captured photos, videos, structured test results, and related documentation so a named certification-body inspector can review submissions and so a buyer can receive a Build Record. CERTAFI does not certify homes, inspect construction, or determine compliance.
CERTAFI is not a certification company. CERTAFI does not certify homes, inspect construction, approve work, or verify compliance with any code, standard, law, or third-party certification program. The Service may store documentation issued by independent certification bodies, but CERTAFI does not endorse, replace, or speak for those bodies.
3. Account Registration
You must create an account to use the Service. You agree to provide accurate, complete, and current information during registration and to update this information as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must be at least 18 years old to create an account. By registering, you represent that you meet this requirement. Accounts are non-transferable.
4. Subscription and Billing
CERTAFI offers subscription plans billed monthly or as otherwise shown at purchase. Subscription fees are charged at the beginning of each billing period. All fees are non-refundable except where required by law or as expressly stated in our refund policy.
You authorize CERTAFI to charge your payment method on a recurring basis for your chosen plan. You may cancel your subscription at any time through your dashboard; cancellation takes effect at the end of the current billing period. We reserve the right to change pricing with 30 days' notice to active subscribers.
Plan limits, included users or Builds, and any usage charges are displayed on the pricing page or in your account. Customer portal accounts are free unless we give advance notice of a change.
An active subscription may be required to create or update Builds and use paid features. After cancellation or nonpayment, we may preserve records and may keep the account read-only. Customer portals may stay available. We do not guarantee indefinite public access. Records a certification body used in a review may remain available to that body. Resubscribing may restore builder access to existing records.
5. Build Records and Service Limitations
Build Records reflect information supplied or selected by builders and other authorized users. CERTAFI provides tools to organize and display that information but does not independently review it for accuracy, completeness, quality, safety, or compliance. A Build Record does not guarantee:
- Compliance with local, state, or municipal building codes or zoning laws
- Physical fitness for human habitation
- Structural integrity beyond what is visible in submitted photos
- Acceptance by any lender, insurer, buyer, regulator, or certification body
Builders are solely responsible for their work, records, required inspections, permits, engineering, and compliance with applicable requirements. CERTAFI does not employ inspectors to approve Builds through the Service.
6. Photo and Data Submission
By submitting photos, documents, or other content to CERTAFI, you grant us a non-exclusive, worldwide, royalty-free license to store, process, and display that content for the purpose of providing the Service. You retain ownership of your submitted content.
You represent that you have the right to submit all content you upload and that such content does not violate any third-party rights. You agree not to submit false, misleading, or fraudulent documentation. Submission of fraudulent documentation may result in immediate account termination without refund.
Live in-app captures may include device-reported location, accuracy, and capture time. Imported uploads are labeled as imported. Those attributes describe what the device or upload path reported. They are not a certification, inspection, or confirmation of construction quality, location, or compliance.
7. Intellectual Property
The CERTAFI platform, including its software, design, logos, and written content, is owned by CERTAFI and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written consent.
Build Records may be shared by authorized users for documentation purposes. The CERTAFI name and logo may not be used in any way that implies certification, approval, compliance, or endorsement without express written permission.
8. Limitation of Liability
To the maximum extent permitted by law, CERTAFI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising out of or in connection with the Service.
Our total liability to you for any claim arising under these Terms shall not exceed the greater of (a) the amount you paid to CERTAFI in the 12 months prior to the claim, or (b) $500 USD.
9. Disclaimer
CERTAFI is not a certification, inspection, engineering, architectural, code-compliance, or legal service. No platform content, status, badge, customer update, or Build Record is a determination of safety, habitability, workmanship, or compliance. The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
Nothing in these Terms limits any statutory rights you may have as a consumer that cannot be waived by contract.
10. Termination
We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, non-payment, or at our sole discretion with reasonable notice. Upon termination, your right to use the Service ceases immediately. Record retention and availability are governed by these Terms and our Privacy Policy.
You may terminate your account at any time by contacting us at support@getcertafi.com. Termination does not entitle you to a refund of any prepaid fees.
