Terms of Service

1. Acceptance of Terms

By accessing or using the CERTAFI platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all users, including builders, company owners, inspectors, and visitors.

We reserve the right to update these Terms at any time. We will notify registered users of material changes by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of Service

CERTAFI is an app-based platform for documenting and certifying tiny homes and recreational vehicles. The Service enables builders to submit GPS-tagged photos and documentation across structured inspection stages, which are reviewed remotely by CERTAFI-credentialed inspectors. Upon successful completion of all stages, a digital certificate is issued.

CERTAFI certifies to NFPA 1192, ANSI A119.5, and NFPA 70 NEC 551/552 standards. The platform is not a licensed engineering firm, code enforcement authority, or government agency.

3. Account Registration

You must create an account to use the Service. You agree to provide accurate, complete, and current information during registration and to update this information as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must be at least 18 years old to create an account. By registering, you represent that you meet this requirement. Accounts are non-transferable.

4. Subscription and Billing

CERTAFI offers subscription plans billed monthly, as well as pay-per-unit options. Subscription fees are charged at the beginning of each billing period. All fees are non-refundable except where required by law or as expressly stated in our refund policy.

You authorize CERTAFI to charge your payment method on a recurring basis for your chosen plan. You may cancel your subscription at any time through your dashboard; cancellation takes effect at the end of the current billing period. We reserve the right to change pricing with 30 days' notice to active subscribers.

Overage charges apply when units certified exceed your plan's unit cap during a billing period. Overage rates are displayed in your account settings.

5. Certification Process and Limitations

CERTAFI certification is based on the documentation submitted by the builder and reviewed by our inspectors. Certification confirms that the submitted documentation meets the standards described above at the time of review. It does not guarantee:

• Compliance with local, state, or municipal building codes or zoning laws
• Physical fitness for human habitation
• Structural integrity beyond what is visible in submitted photos
• Acceptance by any specific lender, insurer, or RV park

Builders are responsible for ensuring their builds comply with all applicable local regulations. CERTAFI inspectors review documentation only and do not conduct on-site physical inspections.

6. Photo and Data Submission

By submitting photos, documents, or other content to CERTAFI, you grant us a non-exclusive, worldwide, royalty-free license to store, process, and display that content for the purpose of providing the Service. You retain ownership of your submitted content.

You represent that you have the right to submit all content you upload and that such content does not violate any third-party rights. You agree not to submit false, misleading, or fraudulent documentation. Submission of fraudulent documentation may result in immediate account termination and revocation of any issued certificates, without refund.

GPS metadata embedded in photos is used to verify the location of the build and may be stored as part of the certification record.

7. Intellectual Property

The CERTAFI platform, including its software, design, logos, and written content, is owned by CERTAFI and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written consent.

Issued certificates may be shared and displayed by the certificate holder for the purpose of demonstrating certification status. The CERTAFI name and logo may not be used in any way that implies endorsement without express written permission.

8. Limitation of Liability

To the maximum extent permitted by law, CERTAFI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising out of or in connection with the Service.

Our total liability to you for any claim arising under these Terms shall not exceed the greater of (a) the amount you paid to CERTAFI in the 12 months prior to the claim, or (b) $500 USD.

9. Disclaimer

CERTAFI certification does not guarantee local code compliance or habitability. The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

Nothing in these Terms limits any statutory rights you may have as a consumer that cannot be waived by contract.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, non-payment, or at our sole discretion with reasonable notice. Upon termination, your right to use the Service ceases immediately. Issued certificates remain publicly verifiable after termination.

You may terminate your account at any time by contacting us at hello@getcertafi.com. Termination does not entitle you to a refund of any prepaid fees.
